Customer Agreement

This rental agreement is made between Costa Rica Private Homes (“CRPH”) and the person signing below (“Guest”) as of the date set forth on the signature page of this agreement. The parties hereby agree as follows. (upon arrival you will receive this in writing and we require your signature to complete the booking.)

1. Guests and Reservation info
The total number of occupants (including children and infants) shall not exceed those listed on the reservation, and shall not at any time exceed the maximum number of occupants allowed for the unit/home. The names of all occupants of the rental property are required in advance. Please list the names in the boxes below:

2. Property Rules
The guest and all occupants agree to abide by the property rules at all times. This includes all in-unit rules and common area rules. Any visitors the guest brings to the property are also subject to these rules under the responsibility of the guest. Visitor policy rules vary by property. If in doubt please inquire with CRPH for your rental property’s visitor policy. 

3. Rates
Rates are quoted on a per night, per week, or per month basis as noted. Unless otherwise noted rates do not include maid service, gratuities, food, liquor, laundry, tours, transportation, personal or household items, or excessive cleaning upon departure. 

4. Maximum Occupancy
Unless otherwise specified, rates are quoted on a 2-person per bedroom basis. Additional guests require written approval and may be subject to a per person per day fee. Charges vary and are subject to change.

5. Term of the lease
The lease begins on the day of check-in, at the moment the guest or any of the registered occupants in the guests’ party gain/s access to the property (check-in). The lease ends at check out or when the guest and all registered occupants vacate the property. Unless otherwise specified check-in is 3:00 pm, and check-out is at 11:00 am. 

6. Reservations and Payments
A completed and signed agreement and rental deposit equal to at least 50% percent of the total reservation amount must be received and accepted by CRPH before confirmation of the reservation. The full balance (total reservation amount) must be received by CRPH at least 30 days prior to the check-in date, or immediately if the payment to reserve date is less than 30 days in advance of the check-in date. Failure to cancel the balance according to these terms will subject the reservation to potential cancellation without refund of any funds received by CRPH or other associated parties. 

7. Condition and Use
The rental property shall be in the same condition upon departure as at check-in, with the exception of normal use. Guest will maintain the property, furnishings, and appliances in good condition and only use items for their specific intended use. Guest must immediately notify CRPH of any damage incurred to the property or items within, including common areas. Failure to notify may incur an additional fee. No items may leave the property at any time.

8. Access
CRPH or its agents may enter the property or unit at reasonable times for any reason including, but not limited to, making repairs, and providing maid service. We will attempt to provide notice before entering and will not disturb guests without a valid reason. 

9. Assignment
Guest may not sublet or assign its reservation or this agreement without the prior consent of CRPH. Access to the property shall not be permitted to anyone but authorized and registered occupants.

10. Limitation of Liability
Under no circumstances shall CRPH be responsible for any loss, expense, damages, claims of injury, direct or indirect, consequential or otherwise, whatsoever or howsoever caused or incurred. Whether arising in contract or otherwise in law or equity as a result of the rendering of the services of accommodations, tours, services, recommendations, and referrals, the Guest understands there are certain inherent risks to person and property during their stay. Guests acknowledge that CRPH would not rent the property unless the guest accepts responsibility for itself, its guests, invitees, service providers, and any other person the guest invites to the property, of all inherent risks associated with their entire stay on and off the property. Guest acknowledges that in all events and circumstances CRPH, its agents or employees, shall not be liable. Guest acknowledges that each property is privately owned. The guest agrees that CRPH and the owners of the property are not responsible for the loss of personal belongings or valuables of the guest. Guest expressly assumes the risk of any harm, damage, or loss.

11. Notice of Absence
Guest agrees to notify CRPH of any absence from the property for more than 24 consecutive hours during their stay. Guest agrees to notify CRPH of the estimated check-out time. 

12. Holdover, Abandoned Possessions, and Service of Notices
If the guest stays in the unit without written permission from CRPH after the check-out time on the check-out date, the guest will be considered a holdover tenant and may be liable for twice the rent under this agreement on a daily basis for each day the guest is a holdover tenant. 

If the guest leaves any personal property which is determined to be of value, as a courtesy CRPH will attempt to contact the guest. If the guest does not respond within 14 days of receiving notice, CRPH may dispose of items. CRPH will not be held responsible for any abandoned possessions at any time. 

13. Cancelation and Refunds
Cancellation more than 60 days prior to check-in date: The guest may cancel the reservation related to this agreement anytime prior to 60 calendar days before the check-in date for a cancellation fee equal to 50% of the total reservation amount.

Cancellation less than 30 days prior to check-in date: In the event that the guest cancels the reservation related to this agreement less than 30 days before the check-in date, all funds received by CRPH will be forfeited.

No shows: In the event, the guest does not show up to the property on the check-in date, the guest will receive no refund and will be charged for the entire reservation amount. Late arrivals must be communicated to CRPH before check-in or will be considered a no-show by 11:59 pm on the day of check-in.

14. Unforeseen Circumstances
Should the home or condominium become untenable or unavailable due to unforeseen events, such as damage, repairs, holdovers, and sale of the unit, CRPH reserves the right to substitute comparable accommodations without liability. Upon notification of the change, the Guest will be given the opportunity to cancel the reservation without penalty if the substitution is unacceptable.

15. Agreement and Signature
By signing below, I the guest, acknowledge that I am aware of, understand, and agree to abide by the terms of this rental agreement, the property rules, and the related enforcement provisions. I understand that I am liable for all members of my group, guests, invitees, service providers, and any other persons that I invite to the property. If CRPH determines, in its complete and sole discretion, that I have violated any of these rules, I agree to abide my CRPH’s enforcement decision, including paying any fines levied against me, and I agree to peacefully leave the property without refund if CRPH decides to eject me from the property for violating the terms set forth in this agreement. Furthermore, I agree that I am fully responsible for any and all costs of damages and repair, replacement of missing items, caused by me or my guests, invitees, or any other person that I bring to the property. I agree that CRPH can deduct from the security deposit collected, or charge the credit card on file, or both, and I will not attempt to charge back or reclaim the charges for the fines or costs of damages or replacement items.
